Zimmer Hip MDL Continues to Advance in New Jersey

Staff Writer | December 12th, 2011

An increasing number of plaintiffs have had their Zimmer hip implant lawsuit, filed by a Zimmer hip lawyer, transferred to the U.S. District Court for the District of New Jersey to be coordinated into multidistrict litigation (MDL). Though the New Jersey MDL continues to progress with a series of status conferences, trial dates have yet to be set for cases alleging some form of Zimmer hip failure.

Creation of the Zimmer hip implant lawsuit MDL

Generally, an MDL is formed to coordinate the pre-trial processes of a large number of lawsuits whose plaintiffs, such as those who have filed a Zimmer hip implant lawsuit, make similar accusations against a shared defendant. Cases remanded to the New Jersey MDL may originally have been filed by a Zimmer hip lawyer in federal district courts across the country. Plaintiffs in these cases allege that the manufacturer never adequately warned them about the risks of Zimmer hip failure associated with the Durom Cup implant.

In June 2010, the Judicial Panel on Multidistrict Litigation (JPML) designated New Jersey District Court as the site for the Zimmer hip implant lawsuit MDL.

Zimmer hip implant lawsuit plaintiffs allege Zimmer hip failure

Zimmer hip implant lawsuit plaintiffs involved in New Jersey MDL were implanted with Zimmer’s Durom Cup hip device, according to complaints drafted by a Zimmer hip lawyer of their own choosing. The Durom Cup is an acetabular hip component that Zimmer temporarily removed from the market in 2008 so that it could investigate reports from patients and physicians about Zimmer hip failure.

The company released the Durom Cup back onto the market after a three-month suspension of sales, this time with more comprehensive surgical instructions. Zimmer claims that it has discovered no evidence that the Durom Cup implant is defective. Despite this fact, Zimmer hip implant lawsuit plaintiffs claim to have experienced side effects of Zimmer hip failure, such as device dislocation leading to the need for revision surgery.

Zimmer hip lawyer may recommend MDL

The New Jersey MDL was formed to streamline and expedite pre-trial processes for Zimmer hip implant lawsuit plaintiffs, as well as defendants. A Zimmer hip lawyer can inform potential plaintiffs that, generally speaking, not only does MDL help reduce costs for all parties involved, it also traditionally results in cases reaching a higher percentage of out-of-court settlements than are typically reached when cases are not grouped into MDL.

What’s next for Zimmer hip implant lawsuit MDL?

Judge Susan D. Wigenton is overseeing the Zimmer hip implant lawsuit MDL. The next step in the MDL process is for Judge Wigenton to decide which Zimmer hip implant lawsuit will be selected for the first  bellwether trial.
