Zimmer Hip Lawsuit Claims Implant Contained Defect
The Zimmer hip lawyer for Louisiana resident Jocelyn Quinn filed a Zimmer hip failure lawsuit on August 30, 2011. In the complaint, the plaintiff claims he suffered from Zimmer hip replacement problems caused by a defect.

On November 14, 2011, the lawsuit was transferred from the U.S. District Court, Eastern District of Louisiana, to the current Zimmer hip multidistrict litigation (MDL) in the U.S. District Court for the District of New Jersey.

According to Quinn’s Zimmer hip lawyer, under Louisiana law, the seller warrants the buyer against redhibitory defects or vices, in the thing sold. A redhibitory defect is such a defect that renders a thing useless, or so diminishes its usefulness or value that it must be presumed that the buyer would not have bought it had he or she been aware of the defect.
Because of this law, Quinn’s Zimmer hip lawyer claims that because of the plaintiff’s alleged Zimmer hip replacement problems, he is entitled to obtain a recission of the sale of the Zimmer Durom Cup.
